במסגרת הליכי הסדר במקרקעין בנגב נדרשת המדינה להגיש תביעות בעלות נוגדות.לצורך כך נדרשת קבלת חוות דעת מומחה לגבי מהות הזכויות ומהות החזקה במקרקעין ,החל מאמצע המאה ה 19 (חוק הקרקעות העותמני) . מהות ההתקשרות הינה התקשרות עם ממומחה בתחום זה,וקבלת חוות דעת מתאימות. חוות הדעת יצורפו גם לכתבי בי דין מטעם המדינה ובמסגרת זו ייתכן כי הממוחה יידרש להיחקר על עדותו בהליכים שונים המתנהלים בבית המשפט.
