Direct Award / Sole Source

Procurement directly from a single supplier without competition, permitted only when defined justifications apply under procurement rules.

Direct award (called sole-source procurement in UN and World Bank terminology) bypasses competitive tendering and places a contract directly with a chosen supplier. It is an exceptional measure, not a standard route. Justifications recognized under most procurement regimes include: only one supplier is technically capable; the contract is for goods or services with intellectual property held exclusively by that supplier; extreme operational urgency precludes time for competition; or contract value falls below the minimum threshold requiring competition.

Contracting authorities must document sole-source justifications formally, and these are subject to audit. Development banks (World Bank, ADB) require prior review and approval for sole-source contracts above certain thresholds in borrower-country projects. Patterns of repeated direct awards to the same supplier are a red flag for procurement auditors and anti-corruption bodies.

For vendors, being selected for a direct award is commercially attractive — no competition, faster process, negotiated terms. However, the relationship comes with scrutiny: any perception of improper influence in securing the award can damage the vendor's broader public-sector reputation. Genuine capability exclusivity (patented technology, unique data assets) is the most defensible basis. Vendors should also note that contracts awarded by direct award are still subject to the full obligations of public contract law, including transparency requirements in some jurisdictions.

Example

A defence ministry awards a direct contract to an existing satellite communications provider citing sole-source justification — no other vendor operates the required frequency band under a national security licence.
